DEVELOPMENTAL STAGES OF FIQH.
The development of Fiqh can be classified into the following stages;-
*Foundation,
*Establishment,
*Building,
*Flowering,
*Consolidation.
Foundation;- being the first stage could be defined as development of Fiqh during the era of Our Noble Prophet (pbuh), because during this stage the only sources of Islamic Law is The Divine Revelation in the form of explanation. The Prophet receives Inspiration to establish Laws. This was the best time of all stages.
The second stage which is the Establishment, is the Era of The Rightly Guided Khalifahs. This occur from the demise of The Holy Prophet Muhammad(pbuh), till the middle of the seventh century. There were Great Khalifahs who call on other trustworthy companions to establish the Fiqh after the Era of Prophet Muhammad (pbuh). They were very careful in passing judgment, because they all fear not to say what the Prophet never said.
The third stage is the Building; this begins from the Umayyad Dynasty found and built until its decline in the means they found and stood on it during the middle of 8th Century C.E after the establishment of the Caliphates.
Flowering as the Fourth stage was from the growth Abbasid dynasty in the middle of the 8th Century C.E to the beginning of its decline around the middle of the 10th century C.E.
The last stage is Consolidation which begins from the decline of the Abbasid dynasty which from about 960 C.E to the murder of the last Abbaasid Khalifahs in the hands of the Monogols in the middle of the 13th Century C.E.
This above stages differ due to different development in Human way of life. Fiqh hereby stand as a removal of difficulties in Islam Allah says in Quran 2vs 185."...Allah intends for you Ease and does not intend for you hardship". In this case Fiqh stand to cast out any difficulty in Islam. The above mentioned stages would be more elaborated in future classes.
